Terms and Conditions and Privacy Policy

INTRODUCTION

The purpose of this document is to provide you with information and services about “I Am Team GB” (the “Events”), a series of participation events to take place on 24th August 2019 at various locations throughout the UK. This website (as well as the “I Am Team GB brand”) is owned by the British Olympic Association (the “BOA”), however, the Events shall be organised and delivered by individual Games-Makers in conjunction with Limelight Sports (as defined below).

This document should be read in conjunction with the general website terms of use and BOA privacy policy.

Definitions

Event Organisers” means the Games-Makers and Limelight Sports.

Games-Maker” shall mean the individuals who register and create Events via this Website, and who shall be responsible for delivery of the Events;

Participant” means the named person on the official entry form.

Limelight Sports” means Limelight Sports Limited, a sports event agency (company no. 3700632) whose registered office is situated at Cox Costello & Horne, Fourth & Fifth Floor, 14-15 Lower Grosvenor Place, London SW1W 0EX

Terms and Conditions” means the terms and conditions set out below.

Website” means www.iamteamgb.com


1. Event Registration 

1.1 These terms and conditions refer to the “Events”, which comprise a series of local events (run nationally) to be organised by local individuals known as “Games-Makers”. The Events shall be registered by Games-Makers via the Website, following approval by Limelight Sports. Additional terms applicable to Games-Makers can be found in section 3.

1.2 Only persons aged 18 years or above on the day of the Event may register for the Event. It may be possible, in respect of some Events, for under 18s (“Minors”) to attend and participate in Events – this will be indicated in the Event description. In the event that Participants do wish to bring Minors, this can be indicated at the time that the adult Participant registers for the event. In the event that a Minor does participate, they must be accompanied by the Participant that registered for the relevant Event, who shall be primarily responsible for the welfare of such Minor at all times.

1.3 The Event Organisers reserve the right to refuse entry to any Participant to the Event. Neither the Event Organisers nor the BOA shall be liable in any way to the Participant as a result of any such disqualification or refusal.

1.4 If any provision in the Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable. The Terms and Conditions shall be subject to English law and the non-exclusive jurisdiction of the English Courts.

1.5 Registration for all Events closes at 23:59 on 21st June 2019. 

 

2. The Event

2.1 The Event Organisers reserve the right to change the time, date and/or venue and format of the Event(s) or to cancel the Event, in whole or in part, without notice or liability to the Participant. In the event that any amendments to the Event take place, the Event Organisers shall use reasonable endeavours to inform all Participants who have registered of any relevant updates.

2.2 The Participant agrees to abide by any rules, instructions or regulations published and displayed from time to time by the Event Organisers or given on the day of the Event to the Participants.

2.3 The Event Organisers shall not provide any insurance, whether life or medical or liability, for any illness, accident, injury, death, loss or damage that may arise in connection with the attendance at, and/or participation in the Event by each Participant. The Participant is advised to obtain such insurance themselves if required.

2.4 The Participant shall be responsible for any medical or transport expenses specifically incurred in connection with any illness, accident or injury sustained or occurring in connection with participation in and/or attendance at the Event.

2.5 The Participant acknowledges and agrees that, subject to clause 2.7, the Participant shall:

(a) fully indemnify and keep the Event Organisers and the BOA fully indemnified from and against all liabilities, claims, actions, proceedings, loss, damage, costs or expenses suffered or incurred by the Participant; and

(b) irrevocably indemnify and hold harmless, and reimburse the Event Organisers and/or the BOA from and for any sum, costs or expenses (including legal and professional fees) incurred, payable or paid by the Event Organisers and/or the BOA to any person (including the Participant’s insurers) in connection with any accident, loss, damage or injury (including death) arising out of the Participant’s attendance at, participation in, or training for the Event.

2.6 Subject to clause 2.7, neither the Event Organisers nor the BOA shall be responsible for any losses the Participant suffers as a result of participating in the Event. For the avoidance of doubt, neither the Event Organisers nor the BOA will be liable to the Participant in contract, tort (including, without limitation, negligence) or otherwise in connection with the Event for loss of revenues, profits, contracts, business or anticipated savings or loss of data); or goodwill or reputation; or any special or indirect or consequential losses.

2.7 Nothing in the Terms and Conditions shall affect the Event Organisers’ nor the BOA’s liability:

(a) for death or personal injury resulting from the negligence or a deliberate act or omission of the Event Organisers, the BOA, its employees or agents (as applicable);

(b) for breach of statutory duty;

(c) for fraudulent misrepresentation; or

(d) to the extent that liability cannot be excluded or limited by law.

2.8 Nothing in the Terms and Conditions shall affect any statutory rights to which the Participant may be entitled to as a consumer.

2.9 The Event Organisers reserve the right to amend, remove or add any terms and conditions at any time.

 

3. Provisions applicable to Games-Makers

3.1 Games-Makers shall register an Event online on the Website by 23:59 on June 21st 2019. All submissions shall be subject to an approval process by Limelight Sports, and shall only be posted as live on the Website upon completion of all relevant information. There is no automatic right to approval of any Event.

3.2 The Games-Makers shall be responsible for all aspects relating to the promotion and delivery of their Event, and for ensuring that the Event is accurately described and marketed.

3.3 The Games-Makers shall take all reasonable steps to assess the safety and suitability of the Event location prior to the Event, with reference to the nature of the Event and the Participants attending. The Games-Makers acknowledge that neither Limelight Sports nor the BOA shall be liable to any Games-Maker in respect any loss suffered by the Games-Maker and/or any Participant as a result of any matter related to or Participation in the Events, and the Games-Makers shall indemnify Limelight Sports and the BOA in respect of any claims brought against them by third parties (including Participants) in relation to such matters.

3.4 The Games-Makers shall store all personal data it may receive relating to Participants safely and securely, and may only use such personal data strictly for the purposes of administering the Event. The Games-Maker warrants that it shall destroy all personal data it holds relating to any Participants within one month following the Event.

3.5 The Games-Makers acknowledge that the personal data they supply shall be processed by Limelight Sports (data processor) on behalf of the BOA (data controller). Such personal data shall be held and processed securely, and you acknowledge that both Limelight Sports and the BOA may contact you with regards to the administration of the Event, and that your basic contact details will be held for a period of 24 months after the Event for the purposes of contacting you with regards to the administration of the Event and/or future Events. You can opt-out of such future communications at any time by contacting info@amteamgb.com and may request the deletion of your personal data from our/ Limelight Sports’ systems at any time.  


4. Use of Data

4.1 This section should be read in conjunction with the BOA’s general privacy policy.

4.2 Any personal data disclosed by Participants in respect of the Events will be processed solely in accordance with current data protection legislation, for the purposes of facilitating the Participants’ entry and participation in the Events only and for the purposes of (for a limited period) informing Participants about future iterations of the Events. Such personal data shall be processed by the Event Organisers and/or the BOA, and – unless the Participant has opted-in to receive future communications – shall be deleted by the same within 24 months of the Event. Participants may request the deletion of their personal data at any time by emailing info@iamteamgb.com

4.3 While medical personnel shall in most cases not be present at an Event, the Participant acknowledges that any medical information provided during registration may, where deemed necessary, be used for assisting medical staff who may attend the scene to treat or otherwise assist the Participant as a result of illness or injury at the Event. The Participant undertakes and agrees to inform the Event Organisers of any change in their medical condition from the date of registration up to and until the start of the Event. Should the Participant have any concerns with regards to fitness to participate, it is their responsibility to get checked by a doctor.

4.4 Limelight Sports and/or the BOA reserve the exclusive right and licence throughout the world (and, the Participant and Games-Maker hereby grants such exclusive right and licence, on a royalty free worldwide sub-licensable basis) to interview and/or photograph and/or film Participants and/or Games-Maker at the Event (or prior to and/or subsequent to the Event as may be reasonably required) and to the unlimited use by Limelight Sports and the BOA or any sponsors, partners or suppliers of the Event in all current and future media (including without limitation, print, audio, audio visual, virtual media, the Internet, mobile telephony and so-called “3-G” technologies, CD-ROM or DVDs) of the Participant/ Games-Maker’s name, likeness and image, signature, voice, video and film portrayals and other means of identification of them, and any biographical or other information or data related to the Participant/ Games-Maker (including race times and results), in connection with the production, advertisement, marketing or promotion of Limelight Sports, of any sponsors, partners or suppliers of the Event or the Event itself.


5. Participants’ Declaration

5.1 The Participant acknowledges that participation in and training for the Events involves potentially dangerous physical activity and inherent risks and dangers of accidents, personal injury (including death) and loss or damage to property. By completing and submitting the Online Registration Form and the Online Confirmation, the Participant confirms that, to the best of their knowledge, they are healthy and fit to participate, they understand and have considered and evaluated the nature, scope and extent of the risks involved, and voluntarily and freely choose to assume these risks (except where any such personal and bodily injury, including death, is caused by the negligence of the Event Organisers). The Participant further understands that the Event Organisers reserve the right to refuse the Participant’s attendance at, and/or participation in, the Event for any reason and at any time.

5.2 The Participants and Games-Makers agree to be bound by the Terms and Conditions.
